1. Contract Formation
By accessing and using the website of Cervanique, you agree to be bound by these Terms & Conditions. Completing a purchase on our website constitutes acceptance of these terms. If you do not agree with any part of these terms, you must not proceed with your purchase.
2. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
3. Consumer Guarantees Preservation Clause
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), which cannot be excluded by contract.
4. Warranties
Cervanique provides voluntary express warranties that are in addition to the mandatory consumer guarantees under the Australian Consumer Law. These warranties do not limit or replace your rights under the ACL.
5. Limitation of Liability
To the extent permitted by law, Cervanique's liability is limited to the replacement or repair of goods, or the supply of equivalent goods. This limitation does not apply to any major failure under the ACL.
6. No Class Action Waiver
We do not include any provisions that would waive your right to participate in a class action. Any such terms would be void under the Australian Consumer Law's unfair contract terms regime (Part 2-3 ACL).
7. Intellectual Property
All content on the Cervanique website, including but not limited to text, graphics, logos, and images, is the property of Cervanique or its content suppliers and is protected by Australian and international copyright laws.
8. User Obligations
Users of the Cervanique website must not engage in fraudulent activities, scrape data, or resell products without authorisation. Any breach of these obligations may result in termination of access to our services.
9. Pricing and GST
All prices displayed on our website are in Australian Dollars (AUD). Cervanique is not currently registered for GST; no GST is added to or collected on sales.
10. Payments
We accept payments through Shopify Payments and Shop Pay. By completing a transaction, you authorise Cervanique to charge the total amount to your selected payment method.
11. Dispute Resolution
If you have a complaint, please refer to our Complaint Handling page. We encourage informal resolution through direct communication. If unresolved, you may escalate the matter to the ACCC or your state fair-trading office. We do not mandate arbitration that would waive your rights under the ACL.
12. Modifications, Severability, Termination
Cervanique reserves the right to modify these Terms & Conditions at any time. Any changes will be posted on this page. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. We reserve the right to terminate access to our services for any breach of these terms.
